These Terms and Conditions govern your use of the AppleTree Cash website and services. By using this site or applying for a loan, you agree to the terms below.

These Terms and Conditions ("Terms") are entered into between you and Cash-X Inc., operating as AppleTree Cash ("AppleTree Cash", "we", "us", "our"), and govern your access to and use of appletreecash.com (the "Site") and any loan services offered through it. By accessing the Site or submitting a loan application, you agree to be bound by these Terms.

These Terms should be read alongside our Responsible Lending Policy and Privacy Policy, which form part of your agreement with us.

Section 01

Eligibility

To use our services, you must be at least 19 years of age, a Canadian citizen or permanent resident residing in Ontario or Saskatchewan, have a regular source of income of at least $400 per pay period, and hold an active Canadian bank account in your own name.


Section 02

Loan Agreements

Any loan issued to you is governed by a separate, individually signed Payday Loan Agreement, which sets out the specific principal amount, term, fees, and repayment date for that loan. Where these Terms and a signed Payday Loan Agreement conflict on loan-specific matters, the signed agreement controls. Cost-of-borrowing figures, licensing information, and your right to cancel a loan are set out in our Responsible Lending Policy.


Section 03

Use of the Site

You agree to use the Site only for lawful purposes and to provide accurate, current, and complete information in any application. You agree not to misrepresent your identity, employment, income, or banking information when applying for a loan.


Section 04

Intellectual Property

All content on the Site — including text, graphics, logos, and design — is the property of Cash-X Inc. or its licensors and is protected by Canadian copyright and trademark law. You may not reproduce, distribute, or create derivative works from Site content without our prior written consent.


Section 05

Disclaimer of Warranties

The Site is provided "as is" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.


Section 06

Limitation of Liability

To the fullest extent permitted by law, AppleTree Cash and its officers, directors, and employees will not be liable for any indirect, incidental, or consequential damages arising from your use of the Site, except where such liability cannot be excluded or limited under applicable Ontario or Saskatchewan consumer protection legislation.


Section 07

Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted to this page, with the "Last updated" date revised accordingly. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.


Section 08

Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the courts of Ontario, except where provincial consumer protection law grants you rights that cannot be waived.
